These Terms are an agreement between you and Onward Media LLC ("we," "us") about using The People's Poll (the "Service"). By using the Service, you agree to them. If you don't agree, please don't use the Service.
The People's Poll tracks published public opinion polls and shows polling averages, trends, and every poll behind each average, with links to the original sources. It's free. It isn't a news organization, a pollster, a campaign or party, or a betting, wagering or prediction market. We're not affiliated with The New York Times or with any pollster whose polls we show.
You must be at least 18 years old. The Service is intended for people in the United States.
Polls can be wrong, and polling averages are estimates. Everything on the Service is general information about published polls. It isn't a forecast, a prediction of who will win, or legal, financial or any other professional advice. Don't rely on it as your only source for any decision.
Poll data comes from published polls compiled by The New York Times and is used under the Creative Commons Attribution 4.0 license. The averages and trend lines are our own calculations, described on our Methods and Sources pages. We take reasonable care to show each pollster's published results accurately, and we fix errors when we find them. Tell us at support@peoplespoll.com if you spot one. Pollsters' question wording and results belong to them.
You're welcome to read, link to and share pages from the Service, and to quote our averages with credit to "The People's Poll." Please don't:
The People's Poll name, logo, design, original question wording and written content belong to Onward Media LLC.
If you join the notify list, you agree that we may send you one email when the People's Poll opens. We handle your address as our Privacy Policy describes, and you can be removed at any time.
Voting isn't open yet. When it opens, these rules will apply, and we may add to them before launch:
We may remove responses or accounts that break these rules.
The People's Poll iPhone app is licensed to you for personal use under Apple's standard Licensed Application End User License Agreement, together with these Terms. Apple isn't responsible for the app or its content, and has no obligation to provide support or maintenance for it; please contact us instead. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, which is zero for this free app. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the app and may enforce them against you.
The Service links to pollsters' releases, The New York Times and other sites we don't control. We're not responsible for their content or practices.
We may change, pause or stop any part of the Service at any time. We may update these Terms. If we do, we'll post the new version here with a new effective date. Using the Service after that date means you accept the new version.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ONWARD MEDIA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY POLL OR AVERAGE IS ACCURATE.
TO THE FULLEST EXTENT THE LAW ALLOWS, ONWARD MEDIA LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS ($50). Some states don't allow certain limits, so some of these may not apply to you.
If you misuse the Service or break these Terms and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to the Service will be resolved in the state or federal courts located in Austin County, Texas, and you and we consent to those courts' jurisdiction. Either of us may instead bring an individual claim in small-claims court if it qualifies.
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't waived it. These Terms and our Privacy Policy are the whole agreement between you and us about the Service. You may not transfer these Terms; we may transfer them to a successor.
